Research conducted by Che Radiah &amp; Masittah (2011) indicates that children, teenagers, adults, and even the elderly have demonstrated the ability to acquire Arabic, either through formal or informal means. Arabic may be studied not only in classrooms and higher education institutions, but also at mosques, suras, public and private Arabic education facilities, etc. Muhammad Sabri (2015) asserts that the Arabic language is fundamental to every Muslim worshiper. It is unsurprising that one of the primary motivations for individuals taking an Arabic language course is to enhance their understanding and deepen their knowledge of religion. This study was conducted to analyze the Arabic language teaching methodology in several Arabic language study centers in Malaysia as well as the factors of Arabic language learning among course participants.. This study applied qualitative study with an interview method. It is anticipated that the study's findings will assist curriculum designers in creating student-centered modules.</em></p> <p>Mempelajari bahasa Arab di Malaysia pada masa kini telah mendapat perhatian dari semua lapisan umur, agama mahupun bangsa. Kajian oleh Che Radiah &amp; Masittah (2011) menunjukkan bahawa kanak-kanak, remaja, dewasa, dan juga orang tua, cenderung belajar bahasa Arab secara formal atau tidak formal. Bahasa Arab bukan hanya boleh dipelajari di sekolah dan IPT malah ia turut dipelajari sama ada di masjid, surau, pusat pendidikan Arab awam dan swasta dan lain-lain. Menurut Muhammad Sabri (2015), semua amal ibadah umat Islam mempunyai kaitan langsung dengan penggunaan bahasa Arab. Maka tidak hairanlah, di antara tujuan utama mereka mengikuti kursus bahasa Arab adalah untuk memahami dan mendalami ilmu agama. This type of recitation does not fulfill any or all of the three criteria for accepting Qiraat Mutawatirah, namely a valid chain of transmission (sanad), conformity with Arabic language rules, and conformity with one of the 'Uthmani codices. Although this recitation is not recognised as the Quran, its acceptance as one of the sources for legal reasoning in fiqh issues is a subject of dispute and debate among fiqh mazhab. Therefore, this article discussed the status and role of Qiraat Shadhdhah in legal reasoning in fiqh. This study focuses on the opinions of the Hanafi and Shafii schools only. The research uses a qualitative method, while data collection is conducted through a literature review. The study found that Qiraat Shadhdhah is an essential source in the legal reasoning of fiqh scholars when determining the ruling on a matter. This importance is evident when some narrations of Qiraat Shadhdhah are still used in fiqh scholars' discussions, even though those recitations have been abrogated. </em></p> <p><em>Qiraat</em> <em>Shadhdhah</em> ialah qiraat yang tidak memenuhi piawaian dan syarat-syarat yang telah disepakati oleh para ilmuan Islam. Qiraat jenis ini tidak melengkapi salah satu ataupun ketiga-tiga syarat penerimaan <em>Qiraat Mutawatirah</em> iaitu sanad yang sahih, bertepatan dengan kaedah Bahasa Arab dan bertepatan dengan salah satu <em>masahif</em> <em>‘Uthmani.</em> Walaupun <em>qiraat</em> ini tidak diiktiraf sebagai al-Quran, namun penerimaannya sebagai salah satu sumber pengeluaran hukum dalam permasalahan <em>fiqh</em> menjadi pertikaian dan perdebatan dalam mazhab-mazhab <em>fiqh</em>. Justeru artikel ini akan membincangkan kedudukan dan peranan <em>Qiraat</em> <em>Shadhdhah</em> dalam penghujahan hukum <em>fiqh</em>. Kajian ini difokuskan kepada pendapat daripada mazhab Hanafi dan Shafii sahaja. Kajian ini menggunakan metode kualitatif manakala pengumpulan data pula dijalankan menerusi kaedah kepustakaan. The field of entrepreneurship needs to be given attention and polished through the lens of Islam to develop according to Islamic principles and shari’ah. In this regard, Muslim entrepreneurs should emulate and appreciate the seerah of Uthman’s well-endowment through the creation of new ventures. The story of Bi’r Ruwmah, also known as the well of Saidina Uthman bin Affan r.a., is mentioned briefly and concisely in the hadith of Al-Bukhari’s narration. It describes the process of starting and developing a business, namely how to plan ideas, find opportunities, prepare plans, and implement strategies. This story can also serve as a guide for Muslim entrepreneurs using the waqf entrepreneurship model. Therefore, this study aims to explore the story of the phenomenon of entrepreneurship in this hadith from the perspective of Islamic entrepreneurship. A qualitative study was carried out to delve deeper into the content of His Prophet's hadith. The study's findings shed light on the Companions of the Prophet's practice of Islamic entrepreneurship, highlighting their character, behavior, thought, action, and strategy to seize opportunities, prioritize the well-being of Muslims, and achieve success in the afterlife. In summary, this story also shows how important it is to prioritize mastery of religious knowledge in understanding creed, worship, and morals while venturing into other fields to produce an execution and thoughts that align with Islamic principles. To enhance the quality of life and fulfill the fundamental needs of the Muslim community, efforts should be sustained by individuals, communities, non-governmental organizations, and government entities to develop endowment-based wells.</em></p> <p>Keusahawanan merupakan sebuah bidang yang dapat memberi manfaat kepada umat Islam. Bidang keusahawanan perlu diberikan perhatian dan digilap mengikut kaca mata Islam agar dapat berkembang sejajar dengan prinsip dan syariat Islam. Antara cabang keusahawanan dalam Islam adalah gabungan wakaf dan keusahawanan yang dapat memainkan peranan terbaik dalam membantu membangunkan masyarakat dan negara. Dalam hal ini, telaga wakaf Uthman menjadi sebuah kisah yang patut diteladani dan dihayati oleh usahawan Muslim dalam proses penciptaan perniagaan baharu. Kisah Bi’r Ruwmah atau juga dikenali sebagai telaga Saidina Uthman bin Affan r.a. telah disebut secara ringkas dan padat dalam hadis Riwayat al-Bukhari menceritakan proses memulakan dan mengembangkan perniagaan iaitu bagaimana merancang idea, mencari peluang, penyediaan pelan dan melaksanakan strategi untuk memilik telaga Ruwmah. Kisah ini juga merupakan sebuah fenomena yang boleh dijadikan sebagai rujukan model keusahawanan wakaf bagi usahawan Muslim. Oleh itu, kajian ini bertujuan untuk meneroka fenomena keusahawanan yang terdapat dalam hadis tersebut dari sudut keusahawanan Islam. Bagi memahami hadis tersebut dengan lebih mendalam, kajian kualitatif telah dilakukan untuk menganalisis kandungan hadis Baginda SAW. Dapatan kajian menghasilkan sebuah gambaran jelas mengenai fenomena keusahawan Islam telah diamalkan oleh para sahabat r.a. dari segi keperibadian, tingkah laku, pemikiran, tindakan dan strategi untuk mencapai sesebuah peluang, tujuan dan hala tuju yang diingini untuk mengutamakan kesejahteraan umat Islam dan keberuntungan di akhirat. Kesimpulannya, penemuan ini juga menunjukkan betapa pentingnya mengutamakan penguasaan ilmu agama dalam memahami ilmu akidah, ibadah, dan akhlak di samping menceburi bidang-bidang lain bagi melahirkan tindakan dan pemikiran yang selari dengan prinsip Islam. The issue of population density in cities and road systems has become a massive challenge to the country's development. Motorcycle taxi services using Internet software booking systems are rapidly developing as a solution to traffic jams. Momentum Works Report for 2022: Gojek (motorcycle taxi) consumption is almost 64 million, compared to 33.6 million in Indonesia, Vietnam, and Singapore. Motorcycles have become popular in Indonesia, India, Cambodia, Vietnam, and Thailand, with over 7 million motorcycles sold since the 1970s. This development sparked the idea of offering a motorcycle taxi in early 2010 via the Gojek application. Today, over 50 cities in Indonesia, including Vietnam and Thailand, utilise it. The traffic congestion crisis and rising public service fares have also affected Malaysia. In early 2019, the initial proposal to expand Gojek in Malaysia sparked controversy, but it faced delays due to various factors. While some individuals praise Gojek for its practicality, the problem of Islamic law and public perception in Malaysia remains unresolved. Academic studies explicitly addressing the Gojek issue are scarce and often focus on the legal implications of having ajnabiyah women in the vehicle, a practice perceived as disrespectful, incompatible with Malaysian customs, and potentially defamatory. The perspective pertains to the social situations that arise during the ride. It's important to note that this restriction is not absolute. With creativity and modern innovation, it is not possible for the motor industry to produce a specific type of motorcycle that meets Islamic standards. This qualitative study explains the riding situations in accordance with syarak and presents several preliminary proposals as a solution to this problem. The motor industry can use this study's formula as a basis to design motorcycles suitable for motorcycle taxis. The government can also set guidelines that are in line with syara’ to preserve the maqasid of sharia.</em></p> <p>Industri pemotoran dan teksi motosikal mempunyai masa depan yang cerah. Isu kepadatan penduduk di kota-kota dan sistem jalan raya menjadi cabaran besar kepada pembangunan negara. Perkhidmatan teksi motosikal melalui sistem tempahan perisian internet berkembang dengan pesat sebagai solusi kepada kesesakan lalu lintas. Laporan Momentum Works bagi tahun 2022; penggunaan teksi motorsikal (g<em>ojek) </em>hampir 64 juta berbanding <em>grab </em>33.6 juta di Indonesia, Veitnam dan Singapura. Sejak tahun 1970-an motosikal mula popular di Indonesia, India, Kemboja, Vietnam dan Thailand dengan lebih 7 juta motosikal. Perkembangan ini mencetuskan idea menawarkan teksi motosikal pada awal tahun 2010 melalui aplikasi <em>Gojek</em>. Kini, lebih 50 kota di Indonesia telah menggunakannya, termasuk di Vietnam dan Thailand. Malaysia tidak terlepas dengan krisis kesesakan trafik dan peningkatan kos tambang perkhidmatan awam. Cadangan awal memperluaskan <em>Gojek</em> di Malaysia mula bergolak pada awal tahun 2019 tetapi ditangguhkan atas sebab tertentu. Walaupun sesetengah pihak menyifatkan <em>Gojek</em> sangat praktikal, namun isu hukum syarak dan persepsi masyarakat di Malaysia masih belum selesai. Kajian-kajian ilmiah secara khusus mengenai isu gojek tidak meluas dan tertumpu kepada aspek hukum membonceng wanita ajnabiyah yang disifatkan tidak sopan, tak sesuai dengan uruf Malaysia dan mengundang fitnah. Pandangan tersebut merujuk kepada situasi-situasi pergaulan ketika membonceng. Hakikatnya larangan ini tidak mutlak. Dengan daya kreativiti dan inovasi moden adalah tidak mustahil bagi industri pemotoran mengeluarkan sejenis motosikal khusus yang menepati piawaian syarak. Sehubungan itu, kajian kualitatif ini menjelaskan situasi-situasi membonceng menurut syarak dan mengemukakan beberapa cadangan awal sebagai solusi kepada permasalahan ini. Rumusan kajian ini boleh dijadikan cadangan kepada pihak industri pemotoran menghasilkan reka bentuk motosikal yang sesuai bagi teksi motosikal. Parents, families, guardians and teachers are responsible for educating and shaping children's behavior, because of the closeness factor and the strongest influence on children. Therefore, this study aims to describe the main methods of education, teaching and learning behaviour towards the formation of commendable values and morals towards children. The approach is discussed from the perspective of famous scholars Abdullah Nasih ‘Ulwan and Muhammad Utsman Najati. This study applies a qualitative research approach with the theme of literature review. Data is obtained from scientific articles and books. The method of content analysis by synthesis is applied to the education method of Abdullah Nasih ‘Ulwan from his work <em>Tarbiyat al-Awlad fi al-Islam</em> and the learning method of Muhammad Uthman Najati from his work <em>Al-Qur'an wa ‘Ilm An Nafs</em> and <em>al-Hadith al-Nabawi wa Ilm an-Nafs </em>as well as from surah Luqman in the al-Quran to discuss value education in behaviour. The results of the study found that the education method in Surah Luqman, Abdullah Nasih ‘Ulwan and the psychological learning method of Muhammad Ustman Najati can be integrated to form a simple and practical behavioural education for parents and guardians. The implication is that the method is seen to be very effective in treating children in line with Islamic Shari'a because it is based on the teachings of the Quran and Hadith, and is even streamlined with the views of contemporary Islamic scholars that are in line with the reality of today.</p> <p>Pembentukan sikap, perangai, tingkah laku dan akhlak terpuji perlu ditanam sejak dari kecil lagi oleh orang-orang yang paling dekat dengan anak-anak. Ibu bapa, keluarga, penjaga dan guru merupakan pihak yang bertanggungjawab untuk mendidik dan membentuk tingkah laku anak-anak, kerana faktor keakraban dan kekuatan pengaruh terhadap anak-anak. Oleh itu, kajian ini bertujuan untuk menghuraikan kaedah-kaedah utama pendidikan, pengajaran dan pembelajaran bagi tingkah laku ke arah pembentukan nilai dan akhlak terpuji terhadap anak-anak. Pendekatan tersebut dibincangkan dari perspektif sarjana terkenal, Abdullah Nasih ‘Ulwan dan Muhammad Utsman Najati. Kajian ini mengaplikasikan pendekatan kajian secara kualitatif yang bertemakan kajian kepustakaan. Data diperoleh daripada artikel ilmiah dan buku-buku. Kaedah analisis kandungan secara sintesis diaplikasikan terhadap kaedah pendidikan Abdullah Nasih ‘Ulwan dari karyanya <em>Tarbiyat al-Awlad fi al-Islam</em> dan kaedah pembelajaran Muhammad Utsman Najati dari karyanya <em>Al-Qur'an wa ‘Ilm An Nafs dan al-Hadis al-Nabawi wa Ilm an-Nafs</em> serta surah Luqman dalam al-Quran bagi membincangkan pendidikan nilai dalam tingkah laku. Hasil kajian mendapati bahawa kaedah pendidikan dalam surah Luqman, Abdullah Nasih ‘Ulwan dan kaedah pembelajaran psikologi Muhammad Ustman Najati boleh disepadukan untuk membentuk satu kaedah pendidikan tingkah laku yang mudah dan praktikal bagi ibu bapa dan penjaga. Hence, understanding the way of life of the Prophet Muhammad PBUH, known in Islamic scholarship as Fiqh Al-Seerah, is necessary to learn about his healthful lifestyle practices. The purpose of this study was to ascertain the degree of knowledge regarding Fiqh Al-Seerah and the correlation between such knowledge and healthy living practices. Since the study was meant to represent the lifestyle patterns of the students, it was carried out using a sample of respondents from Sultan Ismail Petra International Islamic University College. Using a purposive sample of 49 respondents, the study used a quantitative methodology. The association between the two variables was examined using SPSS 20.0 and existing measures. For the variable “students’ knowledge of Fiqh Al-Seerah,” the mean is 5.240 with a standard deviation of 0.4258, while for the variable "healthy lifestyle,” the mean is 3.5814 with a standard deviation of 0.42027. The Pearson correlation between students’ knowledge of Fiqh Al-Seerah and healthy lifestyle is 0.444, and the p-value for this correlation is 0.003, indicating statistical significance. This highlights the importance of Islamic education, more specifically, the importance of Islamic history. Morality is essential for the development, maintenance, and improvement of any community, as well as strengthening the connections between individuals within it. This study aims to clarify the moral principles delineated in the Qur'an by investigating its origin and characteristics. Additionally, it seeks to understand the moral standards that encompass both an individual's internal convictions and beliefs as well as their external conduct and demeanor. The method entails scrutinizing the ethical doctrines present in the Quran's verses. This study employs a thematic interpretation methodology that incorporates a deduction-based analytical descriptive technique. The study's main conclusions, "Morality in the Perspective of the Qur'an," focus on the essential steps and measures required to foster virtue and achieve happiness as a morally upright person. The Qur'an portrays morality as a practical necessity that demands immediate action rather than simply theoretical contemplation. The Qur'an asserts that the right moral principles are derived from divine revelation rather than from rationality or cultural conventions. The moral convictions that govern the sentiments of a Muslim revolve around fundamental principles such as tawhid (the unity of God), tawakkal (dependence on God), intention, and love.</em></p> <p>ينطلق هذا البحث من أهمية معرفة معيار الأخلاق في القرآن ودورها في تكوين صلاح مجتمعٍ الذي يبتدئ من تكوين صلاح إنسانٍ، وتعتبر الأخلاق أمراً أساسياً في سير المجتمعات وصيانتها وتطويرها، وتقوية قوائم الإنسانيات فيها، فيأتي هذا البحث من أجل تسليط الضوء على معيار الأخلاق في القرآن من خلال فهم طبيعة الأخلاق وخصائصها في القرآن من جهة، واستنباط معايير الأخلاق، سواء ما يتعلّق بقلب الإنسان واعتقاده وما يتعلّق بسلوكه وصورته من جهة أخرى، وذلك من خلال استنباط العديد من الآيات القرآنية التي تتحدث عن الأخلاق. وانتهج هذا البحث منهج التفسير الموضوعي بمقاربات وصفية تحليلية من خلال الاستقراء. وأهم نتائج هذا البحث: يتبيّن أنّ الأخلاق في نظر القرآن جوهره الحديث عمّا الذي يجب علينا أن نفعله لنكون أخياراً فضلاء ننعم بالسعادة، ويتحقّق بالعمل والتطبيق، حتّى يحقّق الإنسان ما يصبو إليه من خير وسعادةكما يتبيّن أنّ طبيعة الأخلاق في القرآن عمليةٌ، فهي أمر واجب النفاذ والنهوض بأعبائه وتكاليفه فوراً، ليست مجرّد نظريات قابلة للجدل، ويتجلّى أنّ معيار الأخلاق الصحيح في نظر القرآن هو الوحي، وليس العقل ولا العادة. ومعيارها الاعتقادي الذي يضبط وجدان المسلم هو التوحيد، والتوكّل، والنيّة، والمحبّة.</p> Zamakhsyari bin Hasballah Thaib Copyright (c) 2024 http://ejournals.kias.edu.my/index.php/rabbanica/article/view/316 Mon, 27 May 2024 00:00:00 +0800 Aplikasi Kaedah Al-Barā'ah Al-Dhimmah Menurut Hukum Fiqh Dan Implementasinya Dalam Perundangan Semasa Di Malaysia http://ejournals.kias.edu.my/index.php/rabbanica/article/view/317 <p><em>This article discusses the application of the principle of original freedom (al-asl barÉah al-zimmah) according to Islamic jurisprudence and its implementation in current legislation in Malaysia. The objective of this study is to demonstrate the important role of the stated principle in addressing various issues related to family matters, transactions, and crimes. This study is qualitative in nature and based on a framework of content analysis. Data collection involves referring to exegesis books, Sunnah, classical fiqh texts, principles of jurisprudence, al-Qawaid al-Fiqhiyyah, views of contemporary Islamic scholars, current laws, and content research. The collected data is analyzed and interpreted using deductive, descriptive, and comparative methods to obtain appropriate findings in line with the established research objectives. The results of the study indicate that this principle emphasizes the principle of al-baréah (freedom) possessed by every human being from being burdened with obligations, responsibilities, accusations, or punishments. Findings also show that this principle is based on the Quran and Sunnah and can be applied in various branches of Islamic law, playing a significant role in realizing justice for parties involved in disputes, especially in the aspects of family matters, transactions, and crimes. The implementation of the theories and principles found in this principle will ensure the preservation of the rights and dignity of every individual from both Islamic law and current legislative perspectives.</em></p> <p>Artikel ini membincangkan aplikasi kaedah <em>al-asl barÉah al-zimmah</em>&nbsp; menurut hukum fiqh dan implementasinya dalam perundangan semasa di Malaysia. Objektif kajian ini adalah untuk membuktikan peranan penting kaedah yang telah dinyatakan dalam menghadapi pelbagai isu berkaitan kekeluargaan, muamalat dan jenayah. Kajian ini adalah berbentuk kualitatif berdasarkan kerangka analisis kandungan. Pengumpulan data adalah dengan merujuk kepada buku-buku tafsir, sunnah, kitab-kitab fiqah klasik, usul fiqah, al-Qawaid al-Fiqhiyyah, pandangan ulama Islam kontemporari, undang-undang semasa dan penelitian kandungan . Data-data yang dikumpulkan dianalisis dan dihuraikan dengan menggunakan metode deduktif, deskriptif dan komparatif bagi mendapatkan natijah yang sesuai dan selaras dengan objektif kajian yang telah ditetapkan. Hasil kajian menunjukkan bahawa kaedah ini menekankan prinsip <em>al-barÉah </em>(kebebasan) yang dimiliki oleh setiap manusia daripada dibebani dengan sesuatu kewajipan, tanggungan, tuduhan atau hukuman. Dapatan juga menunjukkan bahawa kaedah ini dibentuk berasaskan al-Quran dan Sunnah dan dapat diaplikasikan dalam pelbagai cabang hukum fiqah serta memainkan peranan yang signifikan untuk merealisasikan keadilan bagi pihak-pihak yang terlibat dalam sesuatu pertikaian terutamanya dalam aspek kekeluargaan, muamalat dan jenayah. Counseling sessions, motivation, and religious guidance conducted by certain parties are necessary, as are mental treatment efforts to support the integrity of a person's soul. This study identifies the attributes of sakinah (calmness) and its connection with the elements of soul therapy in characters in selected novels, namely Imam Markisa and Doa Insan Berkasih by Aminah Mokhtar. This study employs qualitative and literary methods, applies Takmilah Theory to both books, and demonstrates the elements of mental therapy derived from the discovery of the sakinah's qualities. The identification of soul therapy elements in the novels' characters has the potential to infuse the readership with a sense of spirituality. As a result, creative works with Islamic elements have become a necessity and are highly relevant to the primary reading material other than the Quran. Additionally, schools can use it as a literary component (Komsas).</em></p> <p>Kepentingan terapi jiwa dalam masyarakat kini menjadi satu keperluan kepada setiap insan memandangkan gejala stres, penyakit mental dan bunuh diri semakin meningkat dari semasa ke semasa. Sesi kaunseling, motivasi, bimbingan agama yang dijalankan oleh pihak tertentu adalah diperlukan serta usaha rawatan jiwa bagi menyokong keutuhan jiwa seseorang insan. Kajian ini mengenal pasti sifat-sifat sakinah (tenang) dan kaitannya dengan unsur-unsur terapi jiwa pada watak dan perwatakan dalam novel-novel terpilih iaitu novel Iman Markisa dan Doa Insan Berkasih karya Aminah Mokhtar. Kajian ini menggunakan metode kualitatif dan kepustakaan serta mengaplikasikan Teori Takmilah pada dua novel tersebut, bagi memperlihatkan unsur-unsur terapi jiwa daripada penemuan sifat-sifat sakinah tersebut. Penemuan unsur-unsur terapi jiwa pada watak dan perwatakan dalam novel-novel tersebut akan menjadi suntikan jiwa khalayak pembaca. Justeru karya-karya kreatif berunsur Islam menjadi satu keperluan dan sangat relevan menjadi bahan bacaan utama selain al-Quran. In 2017, WHO stated that the tobacco industry is a major contributor to the global pollution crisis, impacting the health and well-being of the worldwide community. In line with WHO's goals, the Malaysian Ministry of Health proposed the Generational Endgame (GEG) policy to curb smoking and nicotine addiction among the younger generation. However, in 2023, the Malaysian government removed nicotine from the list of controlled substances, contradicting the efforts to control smoking and nicotine as per the WHO's aspirations. Accordingly, this study is presented to analyze the challenge of implementing smoking prevention measures in Malaysia based on the hadith perspective. Using the thematic textual analysis method, this qualitative study examines hadiths with the theme of preventing harm in the Kutub Sittah (The Six Major Books of Hadith) to propose guidelines for solving the dilemma of the consistency of the smoking and nicotine prevention agenda in Malaysia. This study concluded that a comprehensive implementation of the smoking prevention agenda in Malaysia is necessary to ensure public health and environmental sustainability.
